Are Facebook, Twitter or similar social networking sites replacing the paper-and-glue scrapbook and photo album in your home? If your estate planning documents do not specifically address digital content, your entire online memory album, messages, personal journals, and photos could disappear at your death without a legal means of obtaining the information by your loved ones. I recommend having an attorney draft a Codicil to your Last Will & Testament that will have carefully drafted language reflecting exactly the scope of your intent to pass on (or not!) your digital content.
